New York Times: Let’s Give Up on the Constitution

Nazis, Communists or Muslim extremists – always tear up existing constitutions when they seize power.

I would like to add a personal note to this story. Did this “Constitutional law professor” consider, even once, that our problems have escalated not because of the Constitution, but because of our representatives lack of obeying its laws? He may have. However, that conclusion in the obvious does not fit his agenda of abolishing the Constitution. Warning, if you are a Patriot in any sense of the word, this article will make your blood boil.

“As the nation teeters at the edge of fiscal chaos, observers are reaching the conclusion that the American system of government is broken. But almost no one blames the culprit: our insistence on obedience to the Constitution, with all its archaic, idiosyncratic and downright evil provisions.”

The article then continues:

“Our obsession with the Constitution has saddled us with a dysfunctional political system, kept us from debating the merits of divisive issues and inflamed our public discourse. Instead of arguing about what is to be done, we argue about what James Madison might have wanted done 225 years ago.”

Then carefully read the next sample:

“This is not to say that we should disobey all constitutional commands. Freedom of speech and religion, equal protection of the laws and protections against governmental deprivation of life, liberty or property are important, whether or not they are in the Constitution. We should continue to follow those requirements out of respect, not obligation.”

So, this “Constitution professor” would like to also -just so we are clear- eliminate the Bill of Rights completely and just trust our government to honor these things out of “respect” for us?  How can this be serious? We have to fight for our liberties even now – when its they’re so called “obligation”- I think whats it’s actually called is LAW.

(Our reps have a history of not following the Constitution, its our duty to hold them accountable. It’s the disregard of the Constitution that has put us in this mess, our lack of following the law, not the law of the land itself that is the problem.)

He continues:

“As someone who has taught constitutional law for almost 40 years, I am ashamed it took me so long to see how bizarre all this is. Imagine that after careful study a government official – say, the president or one of the party leaders in Congress – reaches a considered judgment that a particular course of action is best for the country. Suddenly, someone bursts into the room with new information: a group of white propertied men who have been dead for two centuries, knew nothing of our present situation, acted illegally under existing law and thought it was fine to own slaves might have disagreed with this course of action. Is it even remotely rational that the official should change his or her mind because of this divination?”

So, this “constitutional professor” feels the need to ridicule and mock those with whom he disagrees – in this case, the Founding Fathers of the United States of America. One can only speculate on what the present-day state of the union would be were this man and his comrades had written the Constitution.

Even though the issue of slavery is often raised as a discrediting charge against the Founding Fathers, the historical fact is that slavery was not the product of, nor was it an evil introduced by, the Founding Fathers; slavery had been introduced to America nearly two centuries before the Founders. As President of Congress Henry Laurens explained:

I abhor slavery. I was born in a country where slavery had been established by British Kings and Parliaments as well as by the laws of the country ages before my existence. . . . In former days there was no combating the prejudices of men supported by interest; the day, I hope, is approaching when, from principles of gratitude as well as justice, every man will strive to be foremost in showing his readiness to comply with the Golden Rule [“do unto others as you would have them do unto you” Matthew 7:12] –

Prior to the time of the Founding Fathers, there had been few serious efforts to dismantle the institution of slavery.

Before we go to the next segment I would like to share what another blog stated about this:

“What has preserved our political stability is not a poetic piece of parchment, but entrenched institutions and habits of thought and, most LFZTlimportant, the sense that we are one nation and must work out our differences. No one can predict in detail what our system of government would look like if we freed ourselves from the shackles of constitutional obligation, and I harbor no illusions that any of this will happen soon. But even if we can’t kick our constitutional-law addiction, we can soften the habit.”

Did this professor never hear of amendments?  Oh yes, I am sure he has, but the American people would never allow his far left-wing socialistic thought to become part of our government so his solution is- abolish the Constitution. Trust us. We will give you freedom out of  “respect, not obligation.” Problem is this for Mr. Professor: 

Our rights come from GOD- not from men!
